Some performers let it all out on stage hoping that the over-the-top nature of their show will either add to their musical performance or will distract from their musical performance … whatever the case may be.

Which reason it is in Steve Aoki‘s case is your call.

However, it seems that his little cake-throwing stage gimmick is costing more than a few stained shirts. Aoki is being sued for a head injury that an audience member sustained when he slipped on a piece of cake. (Seriously, does this guy have an attraction to Marie Antoinette bizarre, or what?)

So, aside from the usual “should Aoki throw cake or not” or “the audience member should’ve known” arguments, I want to know what you think about the lawsuit. This is something that could really happen to any of you, even if you don’t throw cake.

Should a performer be held accountable for an accident? Better yet, did Aoki place signs – and generally let it be known – that  this kind of gimmick would happen. If the audience had been informed about the potential danger, does that free Aoki from responsibility?
